Terms & Conditions

Before placing your order, please read carefully these Terms and Conditions. You accept and agree to be bound by these Terms and Conditions when you place an order at our online store.

Delivery

Orders are dispatched 24 hours after being placed placed. (Monday to Friday – we do not dispatch and ship on weekends or UK holidays.)

We ship worldwide! Orders are sent next day with tracked delivery service, please see below for information based on your location.

You should receive an automated email from Royal Mail with your tracking number also confirming that your order is on it’s way with an estimated delivery date (please check your junk folder). You will also receive a shipping confirmation from HOM Clothing, notifying you that your order has been dispatched. 

If you do not receive the emails from either HOM Clothing or Royal Mail, please contact us at info@hitormissclothing.co.uk and we can track down your tracking number.

UK:

Orders are sent next day with a tracked service using Royal Mail, estimated 2-4 working days. This is a set postage fee of £3.20 regardless of weight unless the subtotal is over £60 which will be ineligible to FREE SHIPPING.

EUROPE: 

Orders are sent next day with a tracked service using Royal Mail, estimated 5-10 working days. The postage fee will vary depending on the weight of the order and will be calculated at our checkout page. 

USA:

Orders are sent next day with a tracked service using Royal Mail, estimated 8-12 working days. The postage fee will vary depending on the weight of the order and will be calculated at our checkout page. 

CANADA:

Orders are sent next day with a tracked service using Royal Mail, estimated 8-12 working days. The postage fee will vary depending on the weight of the order and will be calculated at our checkout page.

AUSTRALIA & NZ:

Orders are sent next day with a tracked service using Royal Mail, estimated 10-12 working days. The postage fee will vary depending on the weight of the order and will be calculated at our checkout page. 

REST OF WORLD:

Orders are sent next day with a signed service using Royal Mail, estimated 10-12 working days. The postage fee will vary depending on the weight of the order and will be calculated at our checkout page. 

Stock Availability

All items on the Hit Or Miss Clothing “Online shop” are in stock and available for next day delivery. If for any reason stock is not available to process your order, we will email to inform you. If you paid using a credit or debit card, Clearpay or Paypal you will not be charged for unavailable stock.

Colour

We try to represent our products as accurately as possible through our photography. However, colours may vary depending on customer’s monitor settings and resolution over which we have no control. Therefore, we are unable to guarantee exact likeness of colour as it appears on our website.

Sizes

Sizes can vary between manufacturers, which can cause some discrepancies with your known size. Some garments come in several different fits, which may alter the size you require, depending on desired fit. Measurements of items are shown under the garments on the online store. Placing an order

When you order items online you will not need to register with us by setting up an account and will be paying by guest. Please ensure the details, which you provide on checkout, are correct and complete and inform us promptly of any changes to those details (e.g. change of email or postal address). We reserve the right to refuse access to the Website, remove or edit content, or cancel orders at our discretion. If we cancel an order it will be without charge to you.

VAT and duties

The price of the items will be in line with the price displayed on the website when you placed your order. Although we try to ensure that all prices on the website are accurate, errors may sometimes occur. If we discover an error in the price of items, you have ordered we will contact you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we may treat your order in respect of the incorrectly priced item as cancelled. Custom fees may occur for international orders depending on location and order value – however HOMC want to treat customers fairly and will pay these costs. Please see our Brexit Notice.

Contract & Acceptance

When you place an order to purchase items using the website this is an offer by you to us to purchase those items. We only accept your order when we have confirmed availability and have processed the payment on your credit card/debit card, Paypal or Clearpay successfully. The contract between us is formed at the point when we acknowledge that the order has been dispatched. If an item within your order is not available, we will contact you. We acknowledge that an order has been dispatched by sending you an email summarizing the details of your shipment. Those items which have yet to be processed do not form part of that contract.

Payment

You may pay for your order by supplying your credit or debit card details, by using Paypal or Clearpay. We accept the following card types: Visa Debit, Visa Credit or Mastercard, Receipt of your credit card details and debit of payments does not constitute our acceptance of your order. You are responsible for ensuring the email address and other contact details you provide to us are correct. We will not be responsible if you do not receive the new order or shipment note email or other confirmation from us where the details you have supplied are incorrect or in the event of communication system failures outside our control. You are also responsible if the information provided is incorrect and the order has been dispatched to the incorrect address. This order will not be refunded/resent unless the Royal Mail tracking service status changes to ‘return to sender’. If the order has been requested to be refunded/resent, postage cost will need to be covered or deducted.

An invoice will be sent to the address provided within your details as confirmation that your order has been accepted.

Please do not send us payment information using email, as we cannot guarantee security of data.

Risk & Title

Risk in the items will pass at the time the items are delivered. Ownership of items delivered will only pass when we receive payment in full of all sums due in respect of the items (including packing and delivery costs). If we do not receive payment in full we may, without prior notice, claim from you any items that have been delivered.

Privacy

When you place orders, we collect certain personal and transactional information (e.g. name, address, telephone number, email address, credit/debit card details). For details on how we use this information, please read our Privacy Policy. To fulfil our obligations to you under these Terms and Conditions we communicate with you by e-mail and by posting notices on the Website. You agree to receive communications from us electronically in this way and that electronic communications will satisfy any legal requirement for communications to be in writing.

Losses

We will be responsible for any losses you suffer as a direct result of us breaching these Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract between us for the sale of items was formed (see “The Contract and Acceptance” section above). We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our appointed sub-contractors or agents, whether it be consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.

Our liability to you under these Terms and Conditions will not exceed the total price charged for the items purchased. Nothing in these Terms and Conditions excludes or limits our liability to you for personal injury or death caused by our negligence. We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.

Changes to website and conditions

We reserve the right at any time to make changes to the Website, Conditions and Privacy Policy and such other policies as we may notify you of from time to time. You will be subject to the policies and terms and conditions in force at the time you order items. Changes which we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, they will be deemed severable and will not affect the validity or enforceability of the remaining terms and conditions.

Privacy & Security

Your privacy is importance to us. We promise never to release your personal details to any outside company for mailing or marketing purposes. When you make a purchase from our website, we collect certain personal information from you (for example: your name, email address, payment address and details). All such information is held on secure servers. Hit Or Miss Clothing complies fully with all applicable Data Protection and consumer legislation, and will treat all your personal information as fully confidential. In order to serve you most efficiently, reputable third-party banking (including PayPal & Clearpay) and distribution institutions handle our credit card transactions and order fulfilment. They receive the information needed to verify and authorize your payment card and to process your order. All such organizations are under strict obligation to keep your personal information private.

Your transaction security

We realise how important it is to securely store any information that you provide. Hit Or Miss maintains the highest levels of security using Ecwid. You can therefore rest assured that we take the privacy and security of your payment and personal details very seriously.

Mystery Wheel

If you have spun our Mystery Wheel, you will have received a unique one time use code to use at our online store checkout page (if you have won) and will expire within 30 minutes after being revealed. You must purchase an item at our online store to receive your free prize and will be delivered along with your other items. If you are suspected of cheating, you will be disqualified.

Mystery Box/Mystery T-Shirt

Mystery Box – Depending on which box you have chosen (£50 | £80 | £100 | £150), all items are chosen at random from our whole selection. All items will be the size that you have chosen when purchasing the box.
The contents of the box will add up the value chosen depending on each box (sometimes more, but never under).

The Mystery Box & the Mystery T-Shirt item(s) are non refundable unless of existing damages when receiving your order (which will be exchanged for the same design). We can exchange the sizes of the items if they do not fit, however this would also be for the same design.
If the size you require is not in stock when exchanging, another item of the same value will be chosen at random as a replacement.

Billing & Shipping Address

BILLING ADDRESS – This is the address to where your card is registered to.
SHIPPING ADDRESS – This is the address to where your order will be sent.
If you are paying by card and your billing address is incorrect, our secure pay portal will decline the payment and the total amount will be bounced back into your account within 2 hours. This may show on your statements temporarily as a payment has been processed, however no transaction has been placed successfully.
